The Georgian National Competition Agency completed the investigation based on the complaint of "MGL GEORGIA ". The case concerned the alleged violation of Articles 6 and Article 113 of the Law of Georgia on Competition by “GNS Georgia”. According to the received and processed information, the fact of violation of the law on the part of the respondent undertaking was not confirmed.

Case of “Diplomat Georgia” and “Kant”
2023-08-22

The Georgian National Competition Agency has approved the concentration of “Diplomat Georgia” and “Kant” in the FMCG market. The case concerned the purchase of 75% share of "Kant" by "Diplomat Georgia". The Agency assessed the competitive environment in the import and wholesale trade of food and beverage products, as well as in the market of distribution services. The Agency determined that the implemented concentration in accordance with the Law of Georgia on Competition, does not substantially restrict effective competition and are compatible with the competitive environment.

Case of “White Square Isan” and “Anagi Development 2”
2023-08-22

The Georgian National Competition Agency has approved the concentration of “Anagi Development 2” and “White Square Isan” in the construction market. The case concerned the purchase of a 50% share of "Anagi Development 2"  from "Anagi" by "White Square Isani". The Agency evaluated the market of the construction of residential and non-residential buildings. According to the received and processed material, the volume of the mentioned market in 2022 amounted to 8,084,435,501 GEL, the market concentration index Herfindahl-Hirschman Index (HHI) is 61.41, which is an indicator of a low concentration market. As a result of the implementation of the concentration, the HHI is 64.14, and the index change according to ΔHHI is 2.73. According to the Agency's decision, as a result of the planned concentration, there is no significant change in the concentration index in the relevant market, and its compatible with the competitive environment.

CASE III of oil commodity
2023-08-17

On August 17, 2023, the Georgian National Competition Agency has completed the investigation in the motor fuel market. The case concerns the maintenance of high prices in the retail market of motor fuel in the period of  March-August 2022. The investigation implemented by the National Competition Agency has confirmed the violation of Article 7 of the Law of Georgia on Competition by LLC “LUKOIL-Georgia", JSC “WISSOL Petroleum Georgia", LLC “San Petroleum Georgia", LLC "SOCAR Georgia Petroleum" and LLC "Rompetrol Georgia". According to the Agency’s decision, the undertakings have been subjected to the relevant fine of up to 4 million GEL in total. Moreover, in order to improve the competitive environment in the market, the Agency issued necessary recommendations.

"Delta Development Group" case III
2023-08-09

On December 5, 2022, the Georgian National Competition Agency completed the investigation based on the complaint of "Delta Development Group" on the alleged violation of Articles 6 and 7 of the Law of Georgia on Competition. The investigation confirmed the violation of Article 7 of the Law of Georgia on Competition by the unified economic entity "Tbilisi Business House", and "Tbilisi Business House" (ID: 204564293) and by the individual entrepreneur, Suma Mia, a citizen of Bangladesh. The defendant undertakings were imposed the appropriate financial sanction, as well as ordered to eliminate the violation of the law. The obligation established by the Agency to eliminate the violation of the law was not fulfilled by the parties. Accordingly, due to the failure to eliminate the violation established by the decision of the Agency, the Agency imposed a fine on the unified economic entity "Tbilisi Business House" and Ind. entrepreneur Suma Mia.

Case II of "Redco Management Group"
2023-07-12

National Competition Agency recognized complaint of the Ind. Entrepreneur Yuri Kolpaki as inadmissible, regarding the possible violation of Articles 6 and 11³ of the Law of Georgia on Competition  by "Redco Management Group". The complaint was concerned to the issue of providing specific utility services to the apartments located in the multi-functional complex in the village of Kaishauri, Dusheti district, near Mountain Vartsla. The claims named by the appellant in the complaint stemmed from the contractual relations, which is beyond the competence of the Agency. Accordingly, at the admissibility stage, the Agency determined that the complaint did not meet the material admissibility standards established by the legislation.

Case of "Retko"
2023-07-05

National Competition Agency recognized complaint of the company “Retko” as inadmissible, regarding the possible violation of Articles 10 of the Law of Georgia on Competition by the "Georgian Railways", and regarding the alleged violation of Article 7 of the Law by "Kselmsheni", "Georgian Engineering Company" and "Khada". The complainant contested the 30-day delivery period in the tenders announced by "Georgian Railways". As a result of the analysis, it was determined that the purchasing organization conducted market research twice, within the framework of which at least 6 undertakings met the tender condition. Accordingly, the Agency considered that the complaint did not meet the material admissibility standards established by the legislation.

Case of "Retko"
2023-07-05

The Georgian National Competition Agency considered inadmissible the complaint of the company “Retko”, regarding the possible violation of Articles 10 of the Law of Georgia on Competition by the "Georgian Railways", and regarding the alleged violation of Article 7 of the Law by "Kselmsheni", "Georgian Engineering Company" and "Khada". The complainant contested the 30-day delivery period in the tenders announced by "Georgian Railways" and considered that competition was restricted by this.   As a result of the analysis, it was determined that the procurement organization conducted market research twice, within the framework of which at least 6 undertakings met the disputed tender condition. Accordingly, at the admissibility stage, the Agency found that  the complaint did not meet the standards of material admissibility established by the legislation.

Case 2 of “SEA”
2023-06-21

On September 20, 2022, the Georgian National Competition Agency completed the investigation of the case based on the complaint of "S.E.A" and established the fact of violation of Article 113 of the Law of Georgia on Competition by the company "BST”. The mentioned company was imposed a financial sanction and ordered to eliminate the violation of the law. The obligation established by the Agency was partially fulfilled by the company "BST". Accordingly, due to the partial elimination of the violation the company was imposed a fine.

Case of "Med Pharmacy Group"
2023-06-16

National Competition Agency recognized complaint of the "Med Pharmacy Group" as inadmissible, regarding the possible violation of Articles 6 and 11³ of the Law of Georgia on Competition  by "Dr. Goods".  The complaint was concerned with the damage to the reputation of the complaining company, its groundless criticism and discrediting by the director of "Dr. Goods". The Agency examined the matter at the admissibility stage and determined that there was no reasonable suspicion of a violation of the law, and the Agency considered it inadmissible to start an investigation.
