Case of "Kazbegi 1881"
2023-06-02

National Competition Agency recognized complaint of the " Kazbegi 1881” as inadmissible, regarding the possible violation of Article 11³ of the Law of Georgia on Competition by the companies “Georgia Distribution and Logistics” and “Global Beer Georgia”. The complaint was concerned hanging an informational banner in front of the place of the complainant. At the admissibility stage of the complaint, the Agency determined that the complainant and the respondent are not competing undertakings. The Agency considered that there was no legal basis to initiate an investigation into the case.

Case of "Redco Management Group"
2023-06-01

The National Competition Agency recognized complaint of the Ind. Entrepreneur Viktor Surogin  as inadmissible, regarding the possible violation of Articles 6 and 11³ of the Law of Georgia on Competition by "Redco Management Group". The complaint was concerned to the issue of providing specific utility services to the apartments located in the multi-functional complex in the village of Kaishauri, Dusheti district, near Mountain Vartsla. The Agency studied the issue at the admissibility stage and determined that there was no reasonable suspicion of violation of the law, because the complainant and the respondent are in contractual relations, and the claims named by the complainant was based on contractual relations, which are beyond the competence of the Agency. The Agency considered it inadmissible and refused to initiate an investigation.

Case of "Redco Management Group"

The Georgian National Competition Agency considered inadmissible the complaint of the Ind. Entrepreneur Viktor Surogin, regarding the possible violation of Articles 6 and 11³ of the Law of Georgia on Competition" by "Redco Management Group". The complaint was concerned to the issue of providing specific utility services to the apartments located in the multi-functional complex in the village of Kaishauri, Dusheti district, near Mountain Vartsla. Case of Individual Temur Bolkvadze and "Legometal"
2023-05-18

The National Competition Agency approved the purchase of a 100% share of "Legometal" by Temur Bolkvadze. In order to examine the compatibility of the implemented concentration with the competitive environment, the Agency assessed the competitive environment in the non-ferrous scrap export market. The volume of non-ferrous metal scrap exports in 2021 amounted to 271.7 million GEL, the number of participating entities - 46, the market concentration index (HHI) - 1 474.77, which is an average concentrated market indicator. The Agency has determined that the implemented concentration in accordance with Article 11 of the Law of Georgia on Competition does not substantially limit effective competition and is compatible with the competitive environment.

Case of “Roniko” and “Arttime”

The National Competition Agency approved the purchase of 100% share of “Arttime” by "Roniko". The Agency determined that the concentration implemented between "Roniko" and "Arttime" does not change the commodity structure of the relevant market, and therefore, the concentration is compatible with the competitive environment.

Case of “Silk Road Engineering” and “Pharmarea”

The National Competition Agency approved the purchase of 100% shares of "Pharmarea" by "Silk Road Engineering". The agency evaluated agricultural machinery and of spare parts production market. In 2021, the volume of the wholesale market of agricultural machinery, equipment and property amounted to 169.3 million GEL, the number of participating entities - 134, the market concentration index (HHI) - 463.14, which is an indicator of a low-concentration market. The volume of import of agricultural machinery, equipment and property in 2021 amounted to 186.4 million GEL, the number of participating entities - 1175, the market concentration index (HHI) - 463.14, which is also an indicator of a low-concentration market.

Case of Ind. Entrepreneur Nunu Kintsurashvili
2023-05-10

The National Competition Agency recognized complaint of the Ind. Entrepreneur Nunu Kintsurashvili as inadmissible, regarding possible violations of Article 113 of the Law of Georgia on Competition by the Ind. Entrepreneur Maia Tsagareishvili. The issues raised in the complaint are beyond the competence of the National Competition Agency. Therefore, from the side of the complainant, the additional information requested by the Agency was not submitted within the period determined by the Agency.  The Agency was refused to start the investigation.

Case of "Engineering Monitoring Group”
2023-04-11

The Georgian National Competition Agency completed the investigation based on the complaint of "Engineering Monitoring Group", on the alleged violation of Articles 10 of the Law of Georgia on Competition by the Marneuli Municipality (Marneuli Municipality City Hal)l and the Gori Municipality City Hall. In the frame of the investigation the fact of using the disputed condition in the state procurement process has been revealed by six additional municipalities - Khashuri, Kareli, Kaspi, Dmanisi, Gardabani and Tsalka. According to the Agency's decision, the municipal bodies and as well as other state procurement organizations were instructed to ensure compliance with the principles of competition in the process of forming tender conditions.

Case II of Technical Inspection

The Georgian National Competition Agency completed the investigation based on the complaint of Ind. Entrepreneur Shota Lominashvili, and the fact of violation was confirmed. The case concerned the alleged violation of Article 10 of the Law of Georgia on Competition by the Unified National Body of Accreditation – Georgian Accreditation Center. The violation was related to the written refusal of the accreditation center to start and implement the legal procedures required for accreditation, which was not based on the applicable legislation and caused disruption of the economic activity of the complainant.

Glass waste collection/recycling market Monitoring
2022-12-28

The National Competition Agency, based on the address of the member of the Parliament of Georgia, monitored the glass waste collection/recycling market. According to the monitoring, it was established, that the annual volume of the market is small and does not exceed 2 million GEL. Recently, a new company has entered the glass waste collection market, as a result of which the amount of collected waste, the selling price, and also the number of individuals/legal entities, from which glass waste collection is carried out have increased. According to the Agency's decision, there were no risks of violation of Georgian competition legislation in the mentioned market.
