National Competition Agency Launches Investigation on an alleged fact of Unfair Competition
The Georgian National Competition Agency has launched an investigation into an alleged fact of unfair competition. The issue concerns - the complaint of the company operating in the tourism services market - appropriation of company trademarks and appearance.
To promote competition, timely response, and elimination of unfair competition, an investigation team was set up at the Agency, which was tasked with investigating the issue.
The Agency makes a decision within 6 months of the start of the investigation. Given the importance and complexity of the issue, the case study may long up to 18 months.
Currently, 2 cases are under investigation: 1. in the translation sector - in the direction of abuse of a dominant position and detection of concerted action, and 2. in the insurance/hospital sector - in the case of unfair trading conditions.
In 2021, the Agency completed an investigation into five cases - including three cases of unfair competition, two of which were found breached. Concerted action has been revealed against 4 companies and in one case the restriction of competition by the state agency was not established. Violating companies were sanctioned and appropriate recommendations were issued to regulate the market.
The process of studying 3 cases together with the regulatory bodies of the economy is in progress.
