Competition Agency Has Refused to Admit the Complaint of JSC Skoda Transportation and JSC Skoda Vagonka
Representatives of JSC Skoda Transportation and JSC Skoda Vagonka have submitted the compliant to the Competition Agency on alleged violation Article 6 of the Law of Georgia.
The Agency has discussed the unilateral / individual action of the undertaking, as a substantive condition of Article 6 of the Law of Georgia on Competition, as well as the study of procedural violations, as the authority of the Competition Agency. Also, the Agency clarified the compliant to be reviewed under the Articles 6 and 10 of the Law of Georgia on Competition and the purpose for this.
The Agency has revealed that Tbilisi Transport Company LLC has added a "Stadler" among the first bidders under the EBRD guidelines. This fact precludes the decision t be made and implemented by the Tbilisi Transport Company LLC on its initiative. Therefore, there is no composition of Article 6 of the Law of Georgia on Competition.
According to Article 24 (b) of the Law of Georgia on Competition, due to the lack of a legal basis provided by law, the complaint was refused to admit by the Agency.
