LLC “Ada” has been fined GEL 31,185 for failing to comply with obligations imposed by the Georgian Competition and Consumer Agency (GCCA).
In the case under consideration, four consumers submitted complaints to the Agency concerning alleged violations of Georgian legislation by the trader. The disputed products included various types of technical equipment and furniture.
Following a comprehensive investigation, the Agency established that the trader failed to fulfill its obligations related to the remedy of product defects and did not ensure that the purchased goods were brought into conformity with the terms and conditions agreed under the contract. Furthermore, the trader disregarded consumers’ statutory right, in the context of distance selling, to return goods within a 14 day period without providing any justification. According to the consumers, no effective measures were taken by the trader to restore their infringed rights.
The examination of the case against LLC “Ada” initially concluded with the conclusion of a commitment agreement, under which the trader was required to amend its internal business policies and restore the rights of consumers who may have been adversely affected by its previous commercial practices. However, due to the trader’s failure to comply with the imposed obligations, GCCA reopened the proceedings on the grounds of a potential violation of the law. As LLC “Ada” also failed to fulfill its obligations within the framework of the renewed proceedings, the Agency imposed a fine of GEL 31,185.
