The Georgian Competition and Consumer Agency (GCCA) concluded the examination of a complaint submitted by Bashkir Soda Company JSC against Daphna LLC concerning an alleged infringement of Article 11³ of the Law of Georgia on Competition through the acceptance of commitments at the substantive assessment stage.
Having assessed the commitments proposed by the respondent undertaking, the Agency concluded that their implementation would eliminate the risk of the alleged infringement. Accordingly, the proceedings were closed on the basis of a commitments agreement.
Under the agreement, Daphna LLC is required to implement, within the deadlines established by the Agency, measures aimed at preventing any infringement of the complainant’s intellectual property rights registered and protected in Georgia, as well as eliminating the risk of consumer confusion in relation to the products concerned.
