The Georgian Competition and Consumer Agency completed an investigation into the baking soda production/sale sector and established a breach of Article 113 (unfair competition) of the Law of Georgian on Competition. According to the Agency's decision, the defendant was fined over 14,600 GEL. Within the framework of the investigation, company "Suntrade" has been determined to have violated competition legislation by using a similar/almost identical appearance of a competitor's trademark on the packaging of its own product. According to the Agency's decision, in order to eliminate the infringement of the law, the respondent party was directed to bring its acts into line with competition legislation. In particular, a change in the packaging of one's own product (baking soda) so as to eliminate as much as possible the similarity with the competitor company's external look and the possibility of consumer confusion between the two.
In November 2023, the National Competition Agency completed an investigation based on a complaint filed on March 7, 2023 by „Tsereteli Mexican“ LLC. The investigation confirmed that LLC "Mexican Hot Dog on Tsereteli" and LLC "Mexican on Tsereteli N1" violated Article 113 of the Law of Georgia on Competition. According to the Agency's decision, the mentioned company was imposed a financial sanction and ordered to eliminate the violation of the law.
The Georgian National Competition Agency completed the investigation based on the complaint of "MGL GEORGIA ". The case concerned the alleged violation of Articles 6 and Article 113 of the Law of Georgia on Competition by “GNS Georgia”. According to the received and processed information, the fact of violation of the law on the part of the respondent undertaking was not confirmed.
The Georgian National Competition Agency completed the investigation of the case based on the complaint of "S.E.A", which was related to the possible violation of Article 113 of the Law of Georgia on Competition by the company "BST" operating in the field of tourism services. In particular, the illegal use of identical trademarks and vehicle appearance of the applicant was identified. According to the Agency's decision, the mentioned company was imposed a financial sanction and ordered to eliminate the violation of the law.
The Georgian National Competition Agency completed the investigation based on the complaint of "Delta Development Group". The case concerned an alleged violation of Article 113 of the Law of Georgia on Competition 5 companies operating in the field of translation service. The investigation confirmed the violation of Article 113of the Law of Georgia on Competition by 2 respondent undertakings. The violation was followed by the illegal use of the ISO 9001: 2015 certification and the relevant IQNET logo in business and commercial relations. Accordingly, the companies was imposed a financial sanction and ordered to eliminate the violation of the law.
The Georgian National Competition Agency has completed the investigation based on the complaint of Algorithm, regarding the unfair competition by Algorithm. The investigation confirmed the violation of Article 113of the Law of Georgia on Competition, which was expressed in the presentation/advertising of the product in a way that misleads the consumers. Accordingly, based on the Agency's decision, the respondent "Algorithm" was instructed to conduct the company's advertising policy in such a way as to avoid the risk of confusing it with the applicant company and misleading the consumer.
The Georgian National Competition Agency completed the investigation conducted based on a complaint submitted by "Free Spirit Tours" Ltd. relating to an alleged violation of Article 11 (3) (Prohibition of the unfair actions of undertakings ), paragraph 2, sub-paragraph e (receipt, use or dissemination of scientific-technological, production or trade information or commercial secrets without the consent of their owner) of the Law of Georgia "on Competition" by "Sphinx Travel" Ltd. Based on the conducted investigation, the fact of unfair competition by "Sphinx Travel" Ltd has not been confirmed.
The Georgian National Competition Agency has completed an investigation based on a complaint of the “Insurance Company Unison”, and established the fact of violation of Article 113 of the Law of Georgia on Competition. The case concerned to the activities damaging the reputation of a competing company by the "Insurance Company Aldagi" on the part of the Batumi regional representative. Accordingly, "Insurance Company Aldagi" was instructed to immediately ensure the denial of the spread information by sending an official letter to "Caucasian Metals Terminal" and to provide information regarding the action in writing form to "Insurance Company Unison" and the Georgian Competition Agency.
The National Competition Agency completed an investigation based on the complaint of GT Motors and established the fact of a violation of Article 113 of the Law of Georgia on Competition. The case concerned to the advertising activities implemented by the defendant company, which misled the consumer. It is important to note, that during the investigation, G.T. Motors" eliminated the fact of the violation. In particular, all disputed advertisements posted on the Internet have been brought into compliance with the competition legislation.
LTD “DAZGA” submitted a complaint to the Competition Agency regarding the unfair competition conduct by LTD “SOLWAY.” According to the complainant, LTD “SOLWAY” misguided consumers by using the webpage, with the “GE domain”, analogical to the one belonging to LTD “DAZGA” (dazga.ge). The Agency considered the conduct of LTD “SOLWAY” as unfair competition act and the company was instructed to eliminate the fact of violation.
