The complaint submitted by "GT Group" Ltd was considered inadmissible by the Georgian Competition and Consumer Agency. The complaint was about the vague tender conditions used in one of the state procurements by the Rustavi City Hall, giving an advantage to an undertaking over competitors or potential competitors.
According to the Agency's position, after reviewing the documentation, it was determined that the defendant set the technical parameters of the tender requirements at their discretion, taking into account the municipality's needs. This was also in line with the purpose of the loan given to Rustavi City Hall, and the mentioned technical parameters did not deviate from the needs of the buyer and the scope of the loan's purpose.
After reviewing the facts and legal conditions, the GCCA concluded that there is no evidence of anti-competitive behavior and the complaint did not meet the standard of material admissibility established by the legislation. In particular, there is no reasonable suspicion of violation of the Law and the Agency considered it inappropriate to initiate an investigation.
