As a result of the complaint filed by "Poseidon 2022" Ltd, the Georgian Competition and Consumer Agency (GCCA) is currently investigating the case at the admissibility stage.
The case concerned the alleged violation of Article 7 of the Law of Georgia on Competition (restrictive agreements) by the companies "Golden Fish Batumi" Ltd and "Zundagi" Ltd, as well as the alleged violation of Article 6 (abuse of a dominant position) on the part of "Golden Fish Batumi".
In order to assess the circumstances of the case, the Agency requested relevant documentation from the company, "Golden Fish Batumi" Ltd. Despite receiving the GCCA letter, the company failed to submit the needed documentation within the time frame specified. A fine of 3,000 GEL was levied on the undertaking, "Golden Fish Batumi" Ltd.
For information: According to the first paragraph of Article 32 of the Law of Georgia on Competition - In case of failing to the information requested by the Agency on the basis of this Law within the time limit determined by the Agency, or provision of incorrect or incomplete information to the Agency, a legal entity shall be fined in the amount of GEL 3,000, and a natural person in the amount of GEL 1,000
In 2024, two investigative cases were completed, and three are ongoing. During the reporting period, the GCCA concluded the 7 complaints inadmissible.
