The Georgian Competition and Consumer Agency (GCCA) is currently investigating a potential abuse of dominant position involving „Rustavi Auto Market“ and „Mikado Georgia“. This investigation was initiated following a joint complaint by auto importers.
The investigation concerns on allegations that Rustavi Auto Market and Mikado Georgia have engaged in anti-competitive practices by directly or indirectly imposing unfairly high prices or other inequitable trading conditions for the use of parking spaces within the Rustavi car market.
During the investigation, the Georgian Competition and Consumer Agency (GCCA) requested relevant documentation from the respondent undertakings, Rustavi Auto Market LLC and Mikado Georgia LLC, to establish essential facts in the case. Despite receiving the GCCA's formal request, the companies failed to submit the required documentation within the specified timeframe. When they did respond, the documents provided were incomplete, leading to an initial fine of 3,000 GEL imposed on each company.
The GCCA subsequently extended the deadline and reissued the request, emphasizing the need for full compliance. However, the companies again submitted incomplete information. As a result of this repeated non-compliance, the GCCA imposed an additional fine of 5,000 GEL on each entity.
