The Georgian Competition and Consumer Agency (GCCA) has established that LLC “Nova”, operating in the construction and renovation materials sector, violated the Law of Georgia on the Protection of Consumer Rights by engaging in unfair commercial practices.
As part of the investigation, the Agency determined that during promotional and discount campaigns, the trader failed to properly manage inventory and did not provide consumers with accurate and clear information regarding product availability on its website. Consequently, consumers became aware of the stock shortages only after the promotional period had ended, thereby missing the opportunity to benefit from the advertised discounts.
The GCCA underscores that traders are obligated, both prior to entering into contractual relations and throughout the duration of discount campaigns, to provide timely updates and clear, unambiguous information regarding product availability. If timely updates are not feasible, traders must offer alternative products of the same category (where available) at the discounted price valid on the date the consumer placed the order. Moreover, if a consumer has placed an order and completed a purchase during the discount period, they must not incur any disadvantage as a result of the trader’s improper stock management.
In light of these findings, the Agency has granted the trader a one-month period to address the violation, restore affected consumer rights, and eliminate the identified unfair commercial practice.
