The Georgian Competition and Consumer Agency (GCCA) has imposed a fine of GEL 500 on “Orbi Group Batumi” LLC for failure to submit, in full, the information requested by the Agency.
A complaint was submitted to the Agency concerning allegedly unfair commercial practices on the part of the company, on the basis of which the Agency initiated an examination into a possible infringement of the Law of Georgia on the Protection of Consumer Rights by “Orbi Group Batumi” LLC.
With a view to conducting a thorough examination of the case and verifying the circumstances set out in the complaint, the Authority made repeated requests for specific information from the undertaking. “Orbi Group Batumi” LLC, however, declined to cooperate and refused to submit the requested information, as communicated to the Authority through formal written correspondence.
Under the applicable legislation, the Authority is empowered to require a trader to submit any information necessary for the purposes of an investigation, including information of a confidential nature, and to establish a reasonable time limit for its provision. Failure to submit the requested information within the prescribed time limit, or submission of such information in incomplete form, shall result in the imposition of a fine of GEL 500.
The imposition of a fine does not discharge the undertaking from its obligation to submit the requested information to the Authority.
