GCCA establishes infringement by "Tamoskin"

The Georgian Competition and Consumer Agency has found that LLC "Tamoskin" has infringed the Law of Georgia on the Protection of Consumer Rights.

The inquiry, initiated on the basis of a complaint submitted by a consumer, established that the trader had failed to deliver the product ordered within the agreed timeframe, and had, subsequent to the cancellation of the order concerned, refused to reimburse the amount paid.

Having examined the matter, the Agency considers that this conduct infringes the requirements of the Law of Georgia on the Protection of Consumer Rights, is inconsistent with the principles of fair trading, and is such as to cause material harm to the interests of the group of consumers concerned.

The Agency has required the trader, within a period of one month, to restore the rights of the consumers concerned and to bring its trading policy into conformity with the requirements of the Law.

Pursuant to the Law, non-compliance, or improper compliance, with the Agency's decision within the period thus prescribed may result in the imposition of a fine of up to two percent of the trader's annual turnover for the preceding financial year. Any repetition of the infringement by the trader within a period of twelve months shall result in the doubling of the fine imposed.
