Following an examination of the case, the Georgian Competition and Consumer Agency has established an infringement of the Law of Georgia on the Protection of Consumer Rights by Individual Entrepreneur Nikoloz Chakhaia, trading as "Kheiri Nakhe".
The inquiry established that the trader had systematically failed to observe the delivery deadlines for goods purchased by consumers and, in cases of order cancellation, had delayed the reimbursement of consumers beyond a reasonable time.
Furthermore, an infringement was identified in respect of the delivery of goods as agreed under the contract. In light of the foregoing, the trader's conduct was assessed by the Agency as constituting a misleading commercial practice by action, contrary to the principles of fair trading and materially detrimental to the interests of the relevant group of consumers.
Under the Agency's decision, Individual Entrepreneur Nikoloz Chakhaia was required, within one month, to bring its commercial policy into conformity with the requirements of the law and to restore consumers' infringed rights. Owing to the trader's failure to discharge this obligation within the prescribed time limit, a fine of GEL 1,374 was imposed.
The imposition of the fine does not relieve the trader of its obligation to comply with the Agency's decision and to restore consumers' infringed rights.
