The Georgian Competition and Consumer Agency penalized 6 traders for non-fulfilment of the obligations imposed by the Agency. The case concerns the infringement of the Georgian legislation on the Protection of Consumer Rights, which, according to the Agency's decision, required traders
to bring their trade policy into compliance with the requirements of the relevant articles of the law.
The Agency's monitoring revealed that the decision had not been implemented. Accordingly, Ind. Entrepreneur Maria Kalustian - 600 GEL, "Daria" LLC - 1,088.27 GEL, Ind. Entrepreneur Vladislav Kiriakov - 600 GEL, Ind. Entrepreneur Alexander Vasilev - 600 GEL, "Invest in Georgia" LLC - 1,789.22 GEL and "Harvidenti" LLC A fine of 600 GEL was imposed.
It is essential to note that the imposition of a fine does not relieve the trader of the obligation to comply with the Agency's decision. Furthermore, the Agency enforces the penalty procedure after establishing the infringement, the company does not fulfill its obligations in the direction of protecting of consumer rights.
For information: When a trader fails to execute or improperly executes a decision of the Agency within the period determined by the Agency, the trader shall be penalized. The amount of penalty shall not exceed 2 % of the annual turnover of the trader for the preceding financial year. If, during a period of 12 months, a trader commits a violation repeatedly, he/she shall be subject to a penalty which is double the amount of the previously imposed penalty.
According to the data of January - February 2024, the fact of 4 violations of the rights of the consumer group was confirmed. Due to non-fulfilment of the obligation imposed by the Agency, 11 traders were fined 9,700 GEL. In favor of the consumer, 21 commitment agreements were signed on 23 cases.
