According to the decision of the Georgian National Competition Agency, one more company was added to the case study started in the direction of 4 companies in the pharmaceutical market. In particular, within the framework of the ongoing investigation regarding oncological medicines, taking into account the factual circumstances, additionally identified and studied by the Agency, “S K Impex” was included as a respondent.
Accordingly, regarding the possible violations of Articles 6 and 7 of the Law of Georgia on Competition ( abuse of dominant position and restrictive agreements,) the Agency conducted a market investigation against 5 undertakings - JSC “Gepha”, LTD “Aversipharma”, LTD “PSP Pharma”, LTD “Mermis” and LTD “S K Impex”.
For information: On March 24, 2023, the Georgian National Competition Agency has started the process of investigation in the pharmaceutical market. The case concerns the sharp increase in prices on the part of the importers and distributors of oncological medicines and the establishment of the alleged, identical pricing. The investigation was based on the information and statements made public by the Ministry of Internally Displaced Persons from the Occupied Territories, Labor, Health and Social Affairs of Georgia, regarding the compatibility of the actions of pharmaceutical companies with competition legislation.
At this period, the National Competition Agency is considering 6 investigation cases: in the auto fuel, pharmaceutical, tobacco, maritime transport, fast food and online ticket sales sectors - in the direction of concerted practices, abuse of dominant position and unfair competition.
In 2023, the agency completed two investigations and in both cases established the fact of restriction of competition by the State Administrative Agency (Article 10 of the Law of Georgia on Competition).
