The Georgian National Competition Agency has started administrative proceedings regarding 2 cases of concentration (merger) of undertakings. The case concerns the merger of “Anagi Development 2” and “White Square in Isan” in the developer market and the concentration between “Diplomat Georgia” and “Kant” in the FMCG market.
Within the framework of the administrative proceedings, the Agency is studying the issue of the compatibility of the to be implemented concentration with the competitive environment.
In accordance with the current legislation, the persons interested in the merger of the mentioned companies have the opportunity to present their opinions no later than July 28, 2023, to the e-mail address of the Agency. For information: Concentration subject to notification is allowed only on the basis of the Agency's decision on its compatibility with the competitive environment.
Concentration is subject to notification to the Agency if the aggregate (total) annual turnover of its participants in the territory of Georgia, as of the previous financial year of the obligation to submit the notification, exceeds 20 million GEL and the annual turnover of at least two persons participating in the concentration exceeds 5 million GEL.
In 6 months of 2023, the concentration of 12,119 companies registered in Georgia was verified. The Agency has given approval for 3 concentrations.
