The Georgian National Competition Agency, in order to protect the consumer's rights, established the fact of violation on the part of JSC "TTL USA Group" (USA2GEORGIA). The case concerns the company's failure to provide consumers with necessary information in a timely manner, as well as the implementation of unfair standard conditions and misleading commercial activities through inaction. During the investigation, the Agency established a form for the frequency and format of information that must be provided to consumers. In particular:
1. According to the Agency’s decision, it is important to provide the relevant information correctly, completely, clearly and step by step in order to protect the consumer's rights. Especially in the case of long-term contractual relations, such as international parcel shipping services.
2. According to the Agency’s position, it is crucial to provide the consumer with detailed information regarding the maximum weight of the parcels that can be transported, additionally, defining electrical equipment and electronic products is considered an important aspect of the service. The trader’s responsibility in case of loss/disappearance of the parcel.
3. The Agency considered unfair the standard terms of the contract, which are not complete, easy to perceive and understand for the consumers.
4. During the case study, the Agency determined that the trader had failed to disclose crucial information to the consumer. According to the Agency’s decision, the mentioned action was considered a misleading commercial practice expressed by omission.
According to the Agency's decision, the trader was ordered to restore the violated rights of consumers within one month and to adjust the trade policy to the relevant requirements of the law.
