The Georgian National Competition Agency recently completed a case study against 11 traders into possible violations of the Georgian Law on the Protection of Consumer Rights in the food service sector in Batumi.
Based on the materials that the Agency received and processed, it was concluded that the reference (food) menu was created and posted solely in a non-state language by the companies "Kizil 2023" LLC, "Grill Food" LLC, "Harvident" LLC, "Daria" LLC, Ind. Entrepreneur Andrei Kharbedia, Ind. Entrepreneur Vladislav Kiriakov, Ind. Entrepreneur Alexander Vasilev, "Invest in Georgia" LLC, and Ind. Entrepreneur Maria Kalustiani. Consequently, the consumers entering the food establishments did not have the opportunity to receive information in the state language, clearly and comprehensibly. The Agency established the fact of a violation of the Georgia Law on the Protection of Consumer Rights by the mentioned traders after evaluating and studying the case's circumstances and the evidence that was presented. According to the decisions of the Agency, the traders were ordered to restore the violated rights of consumers within one month and to adjust the trade policy to the relevant requirements of the law.
However, the Agency did not confirm any violation on the part of "Dano" LLC and "Maxi Sandwich Chicken" LLC.
In the process of studying the issue, in order to determine and clarify the relevant circumstances, for not providing the information requested by the agency within the established period, "Gril Food" LLC and "Harvident" LLC were fined in the amount of 500 GEL each. As of today, the mentioned fine has been paid by "Grill Food" LLC.
"Gril Food" LLC and "Harvident" LLC were fined 500 GEL each during the investigation process in order to determine and clarify the relevant circumstances, for not providing the information requested by the agency within the stipulated timeframe. The mentioned fine has been paid by "Grill Food".
For information: In the direction of the protection of consumer rights, from November 2022 – to November 2023, the National Competition Agency has received 462 applications and a case study has been started on 251 applications. In the mentioned period, the Competition Agency signed 77 commitment agreements in favor of the consumer on 117 cases. The 38 facts of violations of the rights of the consumer group were confirmed -in 53 cases, and in 7 cases were not confirmed.
