GCCA penalized "Rustavi Auto Market" and "Mikado Georgia" for providing incomplete information

The Georgian Competition and Consumer Agency (GCCA) is currently investigating a joint complaint filed by car importers regarding potential abuse of a dominant market position by two undertakings: “Rustavi Auto Market” Ltd and “Mikado Georgia” Ltd.


The case concerns, that these companies have possibly exploited their market position by setting unfairly high parking fees or imposing additional restrictive conditions within the Rustavi auto market.


During the investigation of the case, the GCCA requested relevant documentation from the involved undertakings to clarify essential circumstances. Despite receiving a letter from the GCCA, the companies failed to submit the requested documents within the specified timeframe. Once the deadline passed, they provided incomplete documentation. As a result, the undertakings—"Rustavi Auto Market" Ltd and "Mikado Georgia" Ltd—were each fined 3,000 GEL. 


For information: In case of failing to the information requested by the Agency on the basis of this Law within the time limit determined by the Agency, or provision of incorrect or incomplete information to the Agency, a legal entity shall be fined in the amount of GEL 3,000, and a natural person in the amount of GEL 1,000. In case of repeated failure to provide information, a legal entity shall be fined in the amount of GEL 5,000, and a natural person - in the amount of GEL 3,000. 


In 2024, 2 investigations were completed and 4 are in progress. In the reporting period, according to the decision of the GCCA, a decision of inadmissibility was made on 7 complaints.
