National Competition Agency - restriction of competition by "Sakaeronavigatsia" has not been confirmed
Georgian National Competition Agency has completed the investigation of the case based on the complaint of JSC "Insurance Company GPI Holding", which referred to an alleged violation of Article 10 of the Law of Georgia "on Competition" - inadmissibility of restriction of competition by administrative bodies by Sakaeronavigatsia Ltd. In particular, according to the applicant, the conditions restricted in the competition were the conditions set out in the tender documents by Sakaeronavigatsia Ltd. in the electronic tender - the request for confirmation of the reinsurance company and the announcement of the tender, where civil liability, property, employee health, and life insurance services were combined into one lot.
As a result of the investigation carried out by the Agency, the fact of violation of Article 10 of the Law by Sakaeronavigatsia Ltd hasn`t been confirmed. However, the mandatory recommendation for consideration to improve the competitive environment was given to the defendant, In particular, the Agency considered it expedient to periodically research the positive and negative factors and prices of announcing the purchase of civil liability, property, health, and life insurance in one lot, because the market is changing over time - this in itself is reflected in the prices of services.
The National Competition Agency completed 5 investigations in 2021, including 3 cases of unfair competition, among them 2 violations, 1 investigation based on concerted action, which resulted in fines for 4 companies, and 1 on the restriction of competition by an administrative agency, which has not been confirmed. During the current period, 4 concentrations have been approved. The Pharmaceutical Market Interim Report was published and 13 recommendations were issued to increase market competitiveness. There are 2 investigations in progress - on the auto fuel and pharmaceutical market.
